Rental Terms & Conditions

1. Rental Period. The rental period begins on the delivery date and ends on the agreed pickup date. Extended rental periods are subject to additional daily fees as set by Amarillo Dumpster Rentals, LLC. Customer must notify Amarillo Dumpster Rentals, LLC at least 24 hours in advance to extend or reschedule pickup. Time is of the essence with respect to all dates in this agreement.
2. Weight Limit & Loading Guidelines. Customer accepts responsibility and agrees not to exceed the weight limit of the provided dumpster and will follow all guidelines on what can and cannot be loaded into the roll-off dumpster as specified on the Amarillo Dumpster Rentals, LLC website. Should there be anything in question, Customer agrees to contact Amarillo Dumpster Rentals, LLC by phone prior to delivery or pickup to avoid extra charges. Overweight loads are subject to additional tonnage fees billed at the prevailing rate. Customer acknowledges that Texas Transportation Code § 621.101 et seq. governs maximum vehicle weight limits and that Customer bears sole responsibility for ensuring the loaded dumpster does not cause a violation.
3. Placement & Private Property Damage Waiver. Amarillo Dumpster Rentals, LLC will place the roll-off dumpster where directed by the Customer. Customer assumes all risk of property damage to private property, including but not limited to driveways, yards, curbs, french drains, irrigation systems, or tire tracks/ruts occurring during delivery, rental period, or pickup. Amarillo Dumpster Rentals, LLC shall be held harmless for any such damage. Plywood protection is strongly recommended for driveways. Customer warrants that they have authority to authorize placement at the specified location.
4. Public Street or Right-of-Way Placement. If Customer requests that the dumpster be placed on any public street, alley, sidewalk, easement, or other public right-of-way, Customer acknowledges and agrees that:
   1. Customer is solely responsible for determining whether any permit, approval, or authorization is required by the applicable city, county, homeowners association, or other governmental authority, including but not limited to the City of Amarillo, Potter County, or Randall County.
   2. Customer shall obtain all required permits and approvals before delivery and shall provide proof of such permits to Amarillo Dumpster Rentals, LLC upon request.
   3. Customer assumes all responsibility for any fines, citations, penalties, towing, relocation costs, or other expenses resulting from the placement of the dumpster on public property, including any enforcement action under the Texas Transportation Code or applicable municipal ordinances.
   4. Customer agrees to indemnify, defend, and hold harmless Amarillo Dumpster Rentals, LLC, its owners, employees, and agents from any claims, damages, governmental enforcement actions, costs, attorney's fees, or liabilities arising from the requested placement of the dumpster on public property, except to the extent caused by the negligence or willful misconduct of Amarillo Dumpster Rentals, LLC.
   5. Amarillo Dumpster Rentals, LLC reserves the right to refuse or relocate any dumpster if placement would violate applicable law or create an unsafe condition, without liability to Customer for any resulting inconvenience or cost.
5. Prohibited Items. The items listed in the Prohibited Items section below are strictly prohibited and may not be placed in the dumpster under any circumstances. Customer assumes full liability for any fines, disposal fees, remediation costs, or penalties resulting from prohibited items, including but not limited to costs imposed under the Texas Health & Safety Code Ch. 361 (Texas Solid Waste Disposal Act), Texas Water Code Ch. 26, and applicable federal environmental regulations including RCRA (42 U.S.C. § 6901 et seq.). Customer agrees to indemnify Amarillo Dumpster Rentals, LLC for all costs associated with the improper disposal of prohibited items.
6. Loading & Overfill Policy. Do not overfill the dumpster past the fill line marked on the side of the dumpster. Overfilled dumpsters cannot be transported legally under Texas Transportation Code and will not be picked up until excess material is removed by Customer at Customer's expense. An overfill fee of a minimum of $65.00 will be charged to the card on file. Additional trip fees may also apply.
7. Damage to Equipment. Customer is responsible for any damage to the dumpster beyond normal wear and tear during the rental period, including damage caused by fire, improper loading, unauthorized use, or vandalism occurring while the dumpster is in Customer's custody. Customer shall promptly notify Amarillo Dumpster Rentals, LLC of any damage. Repair or replacement costs will be charged to the card on file.
8. Access & Retrieval. Customer must ensure the dumpster remains accessible for pickup on the scheduled date. If the dumpster is blocked and cannot be retrieved, a re-delivery/pickup trip fee will apply. Customer is responsible for ensuring that no vehicles, structures, or other obstructions prevent access to the dumpster.
9. Payment & Fees. Payment is due in full prior to or at the time of delivery unless otherwise agreed in writing by Amarillo Dumpster Rentals, LLC. All fees are stated in U.S. dollars. Returned checks are subject to a $35.00 returned-check fee pursuant to Texas Business & Commerce Code § 3.506. Customer authorizes Amarillo Dumpster Rentals, LLC to charge the card on file for any amounts owed under this agreement, including rental fees, overage charges, damage charges, and any other fees incurred. In the event of a dispute, Customer must notify Amarillo Dumpster Rentals, LLC in writing within 10 days of the charge.
10. Cancellation. Cancellations made less than 24 hours before scheduled delivery may be subject to a cancellation fee not to exceed the full rental amount. Cancellations due to weather or emergency may be rescheduled at no charge at the sole discretion of Amarillo Dumpster Rentals, LLC.
11. Indemnification & Limitation of Liability. To the fullest extent permitted by Texas law, Customer agrees to indemnify, defend, and hold harmless Amarillo Dumpster Rentals, LLC, its owners, members, employees, and agents from any and all claims, damages, losses, costs, and expenses (including reasonable attorney's fees) arising out of or related to Customer's use of the dumpster, Customer's breach of this agreement, or any act or omission of Customer or Customer's agents, employees, or invitees. Amarillo Dumpster Rentals, LLC's total liability to Customer for any cause of action shall not exceed the total amount paid by Customer for the specific rental giving rise to the claim. IN NO EVENT SHALL AMARILLO DUMPSTER RENTALS, LLC BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES. This limitation of liability reflects a reasonable allocation of risk and is an essential basis of the bargain between the parties.
12. Force Majeure. Amarillo Dumpster Rentals, LLC shall not be liable for any delay or failure to perform resulting from causes beyond its reasonable control, including but not limited to acts of God, severe weather, labor disputes, governmental actions, or equipment failure. In such events, Amarillo Dumpster Rentals, LLC will make reasonable efforts to reschedule service.
13. Governing Law & Venue. This agreement is governed by and construed in accordance with the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute arising out of or relating to this agreement shall be resolved exclusively in the state or federal courts of competent jurisdiction located in Potter County, Texas. Customer irrevocably consents to personal jurisdiction and venue in such courts and waives any objection to such venue.
14. Waiver of Jury Trial. TO THE EXTENT PERMITTED BY APPLICABLE LAW, EACH PARTY HEREBY KNOWINGLY, VOLUNTARILY, AND INTENTIONALLY WAIVES ANY RIGHT TO A TRIAL BY JURY IN ANY ACTION ARISING OUT OF OR RELATED TO THIS AGREEMENT.
15. Electronic Signature. Customer agrees that an electronic signature, checkbox acknowledgment, or digital submission of this agreement constitutes a valid and legally binding signature under the Texas Uniform Electronic Transactions Act (Tex. Bus. & Com. Code Ch. 322) and the federal Electronic Signatures in Global and National Commerce Act (E-SIGN Act, 15 U.S.C. § 7001 et seq.). Customer consents to conduct this transaction electronically and to receive electronic records.
16. Severability. If any provision of this agreement is found to be invalid, illegal, or unenforceable under Texas law, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it enforceable.
17. Entire Agreement; Amendments. This agreement constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior negotiations, representations, warranties, or agreements, whether oral or written. This agreement may not be amended except by a written instrument signed by both parties.
